Work safety standards amended to cover transport firms

MANILA, Philippines -- All establishments engaged in land, sea, and air transportation are now covered by occupational safety and health standards (OSHS), after Labor Secretary Marianito Roque issued an order expanding OSHS coverage.

In Department Circular No. 2, series of 2008, Roque amended Rule 1003.03 of the OSHS of the 1974 Labor Code of the Philippines.

Previously, these establishments were not covered by the standards except their garages, dry docks, port hangars, and maintenance and repair shops, Roque said.

Under OSHS, employers are duty-bound to protect workers against the hazards of injury, sickness, or death in workplaces.

"Protecting workers from hazardous workplaces is part of national efforts to ensure the conservation of valuable manpower resources and the prevention of loss or damage to lives and properties in consonance with national development goals and the state's commitment for the total development of Filipino workers," Roque said.

Under the OSHS, hazardous workplaces are those where workers are:

• Exposed to dangerous environmental elements, contaminants or work conditions including ionizing radiation, chemicals, fire, flammable substances, and noxious components;
• Engaged in construction work, logging, fire fighting, mining, quarrying, blasting, stevedoring, dock work, deep sea fishing, and mechanized farming;
• Engaged in the manufacture or handling of explosives and other pyrotechnic products;
• Exposed to power driven or explosive powder actuated tools; and
• Exposed to biologic agents such as bacteria, fungi, viruses, protozoas, nematodes, and other parasites.

Roque said that anyone might request the Department of Labor and Employment to inspect any establishment which could be violating the OSHS and, thus, threatening the lives of its workers.

If a labor inspector finds that an imminent danger exists in a workplace, the labor chief said, he should recommend to the regional labor director the stoppage of operation or other appropriate action to abate the danger.
